As of July 1, 2014, the Small Claims Court of Ontario has instituted new rules. Details of all of the changes can be found here.
One of the most significant changes is that Small Claims Defences will no longer be served upon Plaintiff’s by the court clerk. Instead, you now have to serve your Small Claims Court Defence before filing it, and then you need to file it with an Affidavit of Service proving that you did indeed serve it.
Often times when it comes to litigation the best way to avoid confrontation is to hire a third party Process Server. This also provides the court with an unbiased, professional Affidavit of Service which is more difficult to argue against.
